Flock Focus Friday, 11/21/14 Lawsuit Update

The focus of one Connecticut judge was on my backyard chickens this week as he facilitated a settlement conference between me & Mr. Chicken Chick and the town of Suffield, which sued me for the removal of my chickens from my backyard.
The focus of one Connecticut judge was on my backyard chickens this week as he facilitated a settlement conference between me & Mr. Chicken Chick and the town of Suffield, which sued me for the removal of my chickens from my backyard. If you are not familiar with the history of this ridiculous saga, you can read about it here. The judge met with both sides and their attorneys separately. It was clear that the town had no intention of honoring the Zoning Enforcement Officer's representation to us that we would be in compliance with the zoning code if we leased three acres adjacent to our backyard because he had no authority to make the offer in the first place. Classic governmental overreaching by a loose cannon in town hall, which typically goes unchecked- but not this time. 
I knew that it would be significantly less expensive to purchase the leased acreage from property owner behind us than it would be to try this case to a judge. If I were Warren Buffett or Donald Trump, I would have tried the case, but being a practical person, I was prepared to offer the town one shot at settling this case short of trial: my demand of the town in exchange for bailing them out was a written apology from the Zoning Enforcement Officer stating that he was wrong to do what he did and that he is sorry for causing us significant inconvenience as a result. The town took the deal.

The ZEO, Jim Taylor, actually blurted out loud in court, "I'm not signing it!" at which point his attorneys took him back to the woodshed to put him on the repentance rack for a few stretches and back they came, the ZEO's face noticeably redder and undoubtedly, his blood pressure significantly higher, when the judge took the bench to record the resolution of this inane case formally.

The town will withdraw the lawsuit, my chickens stay with all the rights that come with the Connecticut Right to Farm law and the Zoning Enforcement Officer will continue to seethe about this case indefinitely. Seems fair.

To recap: the town sued me to force me to remove my chickens from my property, ultimately agreeing to apologize for the inconvenience to me of their overreaching AND I keep my flock IN ADDITION TO any farm animal I wish. Sounds like a super smart use of town resources, don't you think?

  43. I'm so incredibly happy for you! It's been a long time coming. I've been following your fight for so long I feel like it's a small victory for myself in some way too. Things are looking up a little here too. I ordered new chicks for the spring. I'm very scared after losing all of mine to a coyote attack a couple months back but hopefully the same mistake of forgetting to lock up the run will never happen again and they'll remain safe and sound. I miss my girls dearly but am looking forward to a new family. I ordered 9 all at once this time instead of 2 batches of 4 so hopefully they'll all get along and won't be as segregated as the last girls were. Enjoy your now acknowledged freedom to farm!!

  163. Glad you won. I have been reading about a lot of towns trying to enact laws against the ownership of poultry. Like where I live, some stupid lady in the other end of town let her chickens loose to "free range"....would have been alright if the chickens had stayed in her yard...but without fences to help contain them the chickens went on a "all you can eat out of the neighbor's yards buffet". I am not currently fenced in all around and I keep my hens under wire cloches and move them through-out the yard. They are safe from the Coopers Hawks which have found my girls and they don't go into the neighbors yards. Where I live I can be "grandfathered in" if it ever comes to it. But I try to be respectful of my neighbors. I don't call on their dogs which bark a lot some days and they don't get upset when my girls do the "somebody just layed an egg" announcement...I just don't keep a rooster right now, but am looking to get one...I just have to put the rooster in the cage which is in the garage and other critters cannot get to them. I call it going to jail...and then being let out on "work program" each morning...Roosters have to earn their keep...LOL

    Congratulations! I am so happy for you! I can relate because we underwent a similar situation with our township. We hired an attorney and they hired three- and we won! It caused us so much stress until finally we had the variance hearing and heard the verdict- Politics are a pain when small town supervisors think they are supreme court judges...!
